OUI Enforcement in Lynn

Lynn Police and Massachusetts State Police both patrol Lynn's roads. Route 1A is the main enforcement corridor. It runs through heavily traveled parts of the city and is the site of many OUI stops each year. The State Police also patrol the nearby highways that feed into Lynn from the north and south.

Essex County logged 1,506 OUI charges in fiscal year 2022, the second highest total of any county in Massachusetts. That is a large number for a county of this size, and it reflects the density of traffic and the active enforcement presence. Lynn is one of Essex County's largest and most active cities, so it contributes meaningfully to that countywide total.

Essex County also sees a high rate of OUI-Drugs charges relative to other counties. That means a notable portion of OUI cases involve drugs rather than alcohol. These cases still fall under MGL c.90 § 24, which covers operating under the influence of any substance that impairs driving.

Note: OUI-Drugs cases follow the same court process and carry the same penalties as alcohol-based OUI charges in Massachusetts.

OUI Penalties That Appear in Lynn Court Records

The penalties attached to OUI cases are part of the public court record. For a first offense under MGL c.90 § 24, fines range from $500 to $5,000, jail time can reach 2.5 years, and the RMV suspends the license for one year. Many first offenders take a 24D disposition under MGL c.90 § 24D. That involves probation, a driver alcohol education program, and a shorter suspension. A 24D disposition can be sealed from public records immediately after the program is complete.

A second offense OUI in Lynn leads to a two-year license suspension. A third offense brings an eight-year suspension. These suspension records are held by the RMV, separate from the court. To check or manage an RMV action tied to an OUI case, visit the Massachusetts RMV driving record page. An unattested record costs $8, and an attested record costs $20.

License reinstatement after an OUI suspension goes through the RMV as well. Details are on the RMV reinstatement page. Reinstatement may require fees, proof of insurance, and program completion depending on the offense level.

Sealing OUI Records in Lynn

Massachusetts allows some OUI records to be sealed from public view. The waiting period depends on the type of record. A 24D disposition can be sealed immediately after you finish the required program. A misdemeanor OUI conviction requires a five-year wait after the case is fully closed. A felony OUI conviction requires ten years. You file the petition to seal at the court where the case was heard, which for most Lynn OUI cases means Lynn District Court.

Sealing removes the record from most public background checks. It does not erase the record from RMV files. Courts and law enforcement can still see sealed records. If you are considering a petition to seal, you can get more information at masscourts.org or by speaking with a legal aid attorney.

Note: A sealed OUI record in Lynn stays visible to the RMV. License suspension history does not disappear when a court record is sealed.
