Essex County Courts for DUI and OUI Cases

Essex County OUI cases are heard at seven district courts. Felony OUI charges, meaning third offense and above, go to Essex Superior Court in Salem. Each court covers a set of towns and cities within the county. The court that handles your case depends on where the arrest occurred, not where the defendant lives. To find a record, you need to know the correct court.

Essex Superior Court is the top-level trial court for the county. It sits at 56 Federal St in Salem, the same address as Salem District Court. This arrangement is common in Massachusetts. Both courts share the building but keep separate clerk's offices and separate case files. DUI records from superior court are for felony cases only.

Lawrence District Court in Essex County handling DUI OUI records

Lawrence District Court processes one of the highest OUI caseloads in Essex County, serving the Lawrence area where active enforcement by local police and State Police produces a steady volume of OUI charges each year.

Essex County OUI Enforcement and Charges

Essex County ranked second in Massachusetts for OUI charges in fiscal year 2022, with 1,506 cases filed. Only Worcester County had more. The county also had the second-highest rate of OUI-Drugs cases in the state. That distinction reflects both enforcement focus and the volume of cases involving substances other than alcohol.

Three highways drive much of the enforcement activity. Route 1 runs north-south through the county and is one of the most actively patrolled roads in the region. I-95 also cuts through the county, with State Police presence at multiple points. Route 128, which overlaps with I-95 in some sections, is another high-enforcement corridor. Lawrence and Lynn see the most OUI cases among the county's cities. Lawrence police and State Police from the Lawrence barracks both contribute to the volume at Lawrence District Court. Lynn sees similar patterns at Lynn District Court.

Under MGL c.90 § 24, first-offense OUI in Massachusetts carries fines of $500 to $5,000, up to 2.5 years in jail, and a one-year license suspension. Defendants who resolve under MGL c.90 § 24D get probation, a 45- to 90-day suspension, and an alcohol education program instead of a conviction. The 24D outcome is common in Essex County courts for first-time OUI defendants. Second-offense OUI brings $600 to $10,000, 30 days to 2.5 years, and a two-year license suspension. Third offense is a felony: $1,000 to $15,000, 180 days to five years, and an eight-year suspension. Those cases go to Essex Superior Court in Salem. Refusing a breath test on a first offense adds a 180-day administrative suspension from the RMV.

Essex District Attorney Public Records Process

The Essex County District Attorney's office has its own process for public records requests separate from the court clerk system. The DA's office holds prosecutorial records: internal files, notes, and communications related to cases it prosecuted. Court records, including OUI dockets and certified copies of judgments, come from the court clerk, not the DA.

If you want records held by the DA's office specifically, the designated public records officer is David O'Sullivan. His email is David.OSullivan@Mass.gov. The DA's office is at 10 Federal St, Salem MA 01970, phone 978-745-6610. The Essex District Attorney's public records request guidelines explain what is available, what is exempt, and how to submit a request.

Some records the DA holds are exempt from public disclosure. These include records related to ongoing investigations, identifying information about certain individuals, grand jury minutes, and medical records. CORI-protected information is also exempt from public records requests to the DA's office.

Certified Copies: The District Attorney cannot provide certified copies of court records. For certified OUI case documents, you must contact the clerk's office at the courthouse that handled the case, not the DA's office.

Most people searching Essex County DUI records need documents from the court, not the DA. Go to the clerk at the correct courthouse for certified copies of charging documents, dispositions, and case records. Contact the DA only if you specifically need prosecutorial records.

The Essex DA public records guidelines page at mass.gov covers the full request process and typical response timelines.

Getting Copies of Essex County DUI Records

Copy fees are the same at all Essex County courts. Non-certified copies are $0.05 per page. Certified copies cost $2.50 per page. A certificate of orders is $20. These rates are set by the Massachusetts Trial Court. They apply whether you go to the Salem Superior Court clerk or the Haverhill District Court clerk. Pay by check or money order for mail requests.

For in-person requests, go to the clerk's office at the courthouse where the OUI case was filed. Bring photo ID. Give the clerk the defendant's name or the case number. The clerk will locate the file and can make copies while you wait or ask you to return. Bring enough funds to cover the copy costs; some courts may not accept cards.

Mail requests go to the clerk's office at the specific courthouse. Your letter should include the case number, defendant's name, a list of documents you need, a self-addressed stamped envelope, and payment. If you are not sure of the exact copy cost, include a check for $20 to $30 to cover most standard requests, and the clerk will contact you if there is a balance due.

Driving Records and CORI in Essex County OUI Cases

OUI outcomes in Essex County appear in two places: the court case file and the RMV driving record. These are different records held by different agencies. After an OUI conviction or admission, the court notifies the RMV, which then suspends the license and adds the action to the driving record. You need to request each type of record from the right source.

Driving records are available from the RMV. An unattested record costs $8. An attested (certified) copy costs $20. The driving record shows license suspensions, reinstatements, and any OUI-related administrative actions. It does not include the court case details. If you need to reinstate a license after an Essex County OUI suspension, the reinstatement process is at mass.gov.

Criminal Offender Record Information (CORI) is statewide and managed by the Department of Criminal Justice Information Services. A CORI request costs $25 and covers all Massachusetts courts, including all Essex County district and superior court OUI cases. CORI is available through DCJIS. A 24D disposition can be sealed immediately when probation ends. Misdemeanor OUI convictions are sealable after five years. Felony OUI is sealable after ten years. Once sealed, a record does not show up in CORI but remains accessible in the court file to those with a right to access it.

Essex County OUI cases, like all Massachusetts OUI matters, are public court records unless sealed. Anyone can search MassCourts and view the case docket. For the full case file, including police reports or other documents filed with the court, you need to request copies from the clerk using the process described above.
