Worcester County Courts and OUI Records

Worcester County has more district courts than any other county in Massachusetts. There are eleven in total, plus Worcester Superior Court for felony cases. Each court serves a defined set of towns and cities. OUI and DUI records from these courts are separate files. If you are looking for a record, you need to know which court handled the case, because clerks only have files from their own jurisdiction.

Worcester Superior Court handles every felony OUI charge in the county. Third-offense OUI and above are felonies under MGL c.90 § 24. The superior court is also where serious OUI cases involving injury or death are tried. The court shares its building with Worcester District Court at 225 Main Street in the city of Worcester.

Worcester County Superior Court for DUI OUI felony records

Worcester Superior Court is the courthouse of record for all felony OUI cases filed in Worcester County, making it the place to go for serious DUI records involving third-offense charges or OUI with injury.

Worcester County Leads Massachusetts in OUI Charges

Worcester County filed 1,591 OUI charges in fiscal year 2022. That is the highest total of any county in Massachusetts. The county is also the largest by area in the state at 1,579 square miles, and it has a dense network of major highways that see active State Police enforcement year-round.

I-290 runs through the city of Worcester and connects to I-395 and Route 146 heading south. I-190 links Worcester to Leominster and Fitchburg in the northern part of the county. The Mass Pike (I-90) crosses the southern edge. Route 2, known as the Mohawk Trail corridor, runs east-west through the northern section. State Police patrol all of these routes. The Clinton District Court serves the Route 2 corridor, which is one of the more heavily patrolled stretches in the county.

Fitchburg and Worcester city see the highest OUI arrest rates within the county. Both have active local police departments that also make OUI arrests in addition to State Police activity. Fitchburg District Court and Worcester District Court handle the bulk of the misdemeanor OUI caseload.

First-offense OUI under MGL c.90 § 24 carries a fine of $500 to $5,000, up to 2.5 years, and a one-year license suspension. Many first offenders in Worcester County courts resolve under MGL c.90 § 24D, which provides for probation, a 45- to 90-day license suspension, and mandatory alcohol education. Second offense brings $600 to $10,000, 30 days to 2.5 years, and a two-year suspension. Third offense OUI is a felony with $1,000 to $15,000 in fines, 180 days to five years, and an eight-year suspension. Refusing the breath test on a first offense triggers a 180-day administrative suspension from the RMV, separate from any court action.

Requesting Copies of Worcester County OUI Records

Copy fees are the same at every court in Worcester County. Non-certified copies are $0.05 per page. Certified copies cost $2.50 per page. A certificate of orders is $20. These are set by the Massachusetts Trial Court and do not vary by courthouse. Pay by check or money order for mail requests. In-person payment options vary; call the clerk's office before you visit if you plan to pay by card.

For copies from Worcester Superior Court, mail your request to: Clerk's Office, 225 Main St, Worcester MA 01608. Include the case number, defendant's name, and a description of the documents you need. Attach a self-addressed stamped envelope and payment. For Worcester District Court, you can also send requests by email to cmworcesterdc@jud.state.ma.us, though the clerk's office may ask you to follow up with a written request and payment before releasing copies.

City records are different from court records. If you need the court file for an OUI case, go to the courthouse, not the city's law department.

Worcester District Court handles the largest share of misdemeanor OUI cases in the county, making it the most common destination for DUI record requests in Worcester County.

RMV Driving Records and CORI After an OUI in Worcester County

Court records and driving records track OUI outcomes through different systems. The court file is held by the clerk at the courthouse. The driving record is held by the Registry of Motor Vehicles. After a Worcester County OUI conviction, the RMV suspends the license and logs the action on the driving record. You need to request each record separately from the right agency.

Driving records are available from the RMV. An unattested record is $8. An attested (certified) record costs $20. The driving record shows suspensions, reinstatements, and any OUI-related license actions tied to Worcester County cases. It will not show the full court case details or the disposition language from the judge. If you need to reinstate a license suspended for OUI, start the process at mass.gov.

Criminal Offender Record Information (CORI) is a statewide criminal history report managed by the Department of Criminal Justice Information Services. A CORI request costs $25 and includes court activity from Worcester County and all other Massachusetts courts. CORI is available through DCJIS. Records resolved under 24D can be sealed right away when probation is complete. Standard OUI misdemeanor convictions are eligible for sealing after five years. Felony OUI records are eligible after ten years. Sealed records do not appear in CORI but the court file remains and is accessible to the public.
